We (Polish team) kindly ask the Jury to reconsider your decision regarding protest number 9 based on the fact that in our opinion inadequate penalty has been applied for our actions. SWE team had a very similar situation and they were neither protested nor received any penalty for their actions. In addition the example of SWE team clearly shows that our concerns of damaging the sail were correct as SWE had their sail ripped before cutting off the drop line. As mentioned during the hearing yesterday our action was only intended to reduce further damages to the equipment and prevent the sail from being ripped. We have taken numerous attempts to solve the problem and to our best knowledge cutting off the line was the only option at that time to protect the sail.
We believe that DSQ in a situation where breaking SI 5.2 is subject to a discretionary penalty is extremely severe, since our action was aimed to handle the supplied equipment in the best way in given circumstances and did not improve our result.
We know that according to appendix UF as a party we cannot ask for reopening however based on the basic principles of sportsmanship we hope that the Jury will reconsider our request to reanalyze this case and give a decision that would be fairly perceived by all teams and in the spirit of the game.
